PEOPLE'S MINING SHOULD BE REGULATED UNDER RPP MINERBA
The Indonesian Institute of Science (LIPI) has called on the government to include a specific provision for people’s mining in the draft government regulation (RPP) on Mineral and Coal Mining (Minerba).
Head of the Bureau of Technical Research of LIPI Iskandar Zulkarnaen believes the lack of a specific regulation would kill off this people’s enterprise, and indeed potentially lead to conflict ”There must be special provisons available to regulate community mining because of its prevalence in Indonesia,” he said yesterday.
Iskandar also mentioned that the RPP tends to treat community mining on the same level as corporate mining with all its related obligations, whereas in reality it would be difficult if not impossible for the communities to fulfill the inticrate licence processings the corporations are subjected to including the obligations to pay royalties to the government.
”There should be more flexible regulations and involving the regional administrations as well.” Iskandar finds previous legislation, i.e. Law No. 11/1967 on Mining Principles actually more accommodating to community mining.
According to him the above law not only regulates community mining comprehensively but also defines it more accurately. Law No. 4 of 2009 concerning Minerba doesn’t.
”The government should keep the RPP on hold for the time being and start making provisions for community mining.
LIPI intends to carry out a study on community mining in several areas such as in South East Sulawesi the results of which could serve as additional material for the Minerba RPP which regulates the mining regions.
Iskandar believes the government needs to make more comprehensive regulations in an effort to repress the threat of conflicts in mining regions.
A case in point is the status of mining areas located in protected regions.
Iskandar says various departments are still very sectorial ego-centric leading to such conflicts.
”It would be good if the president would issue a national policy that can stifle such ego-centric orientation,” he said.
”In addition mining corporations should be able to chart areas with potential conflicts inside the mining areas,” he said.
”For instance, companies should not take on the government’s role building infrastucture, giving social assistance etc themselves. They should leave these tasks up to the government,” he said.
