THE INDONESIAN GOVERNMENT IS CONSIDERING SETTING A REGULATION ON THE MINIMUM PURITY TO REGULATE UNPROCESSED ORE BAN
COALspot.com: Energy and Mineral Resources Minister Jero Wacik recently proposed to house those mining (mineral) companies that had shown a commitment to build smelters ought to be exempted from the upcoming export ban on raw ore. However the proposal was rejected by house member of commission VII who is overseeing energy ministry. According to majority of members of commission VII, the mining companies had already been given more than four years to comply with the requirement; hence the export ban has to be implemented fully by 12 January 2014.
In the meantime, according to circular No. 04/M-DAG/ED/12/203 dated 9 December posted on minerba's website, says that the unprocessed ore export will be allowed until 12 January 2014. The circular was signed by Bachrul Chairi, the director general for foreign trade of Trade Ministry of Indonesia. It is mean, no unprocessed ore exports will be allowed after 12 January 2014.
However the industry players says, most of the country’s miners including large scale miners would be unable to comply with the law, which only allows the export of ore that has first been processed in domestic smelters beginning January 12' 2014. Constructing a smelter and a power plant are requiring a huge amount of fund, time and certainty of raw material supply.
As quoted by a local news paper, the government is still seeking a way, without breaking the law, to allow mining companies that have concrete plans to build smelters to still be able to export their ore.
Ali Mardi, partner of Pricewaterhouse coopers says, during PWC's Mining Breakfast Technical Update, today, MoEMR regulation No.7/2012 and its amendments governs in-country mineral processinghas been revoked by country's Supreme court recently, this mean there are currently no rules to implement the in-country processing requirements, but the mining law is still in force to ban the export.
In the meantime, the Trade Ministry’s director general for foreign trade, Bachrul Chairi, said Tuesday that the government was considering setting a regulation on the minimum purity threshold for processed ore produced by local mining companies, as quoted by the Jakarta post.
Country's mining sector particularly ore miners and exporters are awaiting a clear guidance or regulation from the government on unprocessed ore export ban by 12 January 2014, The planned raw ore export ban at the start of the new year, but government has yet to offer a concrete implementation statement.
Marwan Batubara of Indonesian Resources Studies (IRESS) said firmer official statements were necessary to give certainty to the market about the implementation of the mining law, as quoted by JP yesterday.
