INDONESIA'S FORESTRY DEPARTMENT IS TO INCREASE BORROW-TO-USE PERMITS (IJIN PINJAM PAKAI) FEE SOON
COALspot.com : Indonesia to increase borrows-to-use permit fees by 33.33 percent. The government of Indonesia is planning to increase the state’s non-tax revenues (PNBP) by raising the fee for a borrow-to-use permit (Ijin Pinjam Pakai) from Indonesian Rupiah 3 million (approximately US$ 309.85) to Indonesian Rupiah 4 million (approximately US$ 413.13) per hectare per annum. According to the government regulation, no. 2 of 2008 IPPKH, a tariff of Rp. 3 million (approximately US$ 309.85) per hectare, to be paid to obtain a borrow-to-use permit, in particular for mining activities.
The fee increase will be varied depends on industry. However, the highest increase will be for mining activities. This increase of permit fee is part of implementation of Law. 41/1999 on Forestry, according to minister of Forestry.
The minister of Forestry recently said to media that, "Currently we are waiting for the Government Regulation." According to him, Indonesian cabinet has agreed to increase fee and waiting for government regulation, which has to be signed by President of Indonesia.
Media reports further said that, Indonesian Ministry of Forestry had issued 735 (total) borrow-to-use permits (Ijin Pinjam Pakai) as of January 2013.
466 permits issued specifically for exploration purpose covering around 2.434 million hectares related to oil and gas, metals, other minerals, coal, mineral C, geothermal and mine infrastructure industry. In addition to that, Ministry also has issued another 369 permits for exploitation purpose covering 366,703 hectares.
According to an Article, 50 paragraphs (3) of Law no. 41 Years 1999 on Forestry ("Law 41/1999") any activity in forestry area is prohibited before obtaining the permit from the competent authority (the Ministry of Forestry). Prior to obtain the borrow-to-use permits, the mining activities, including exploration should not be conducted.
The company which violates the provisions is subject to criminal sanctions under Article 78 of Law 41/1999, such as including but not limited to imprisonment (for the director or authorized to represent the company) and fines and also confiscation of machineries, heavy equipments and other equipment used to explore, exploit and transport.
