GOVT WAITS LEGAL DECISION ON BUKIT ASAM, ADARO DISPUTE - JP
The Jakarta Post reported that, The government says that it will not interfere in the settlement process of the dispute between state coal miner PT Bukit Asam and the country’s second largest coal producer, PT Adaro Energy, on an overlapping mining area.
Director general for minerals and coal at the Energy and Mineral Resources Ministry Thamrin Sihite said that the government would wait for a legal decision on the dispute.
“The government will comply with the decision,” he told reporters after attending the launch of the Indonesian Coal Index (ICI) 5, a reference price for low-rank coal, in Jakarta on Thursday.
Overlapping mining areas often happened in the country after the implementation of regional autonomy, he reported.
“In many cases, regent A gives a mining permit to a company, but then regent B, who replaced regent A, also gives a permit for the same area to another company. That happens very often across the country,” said Thamrin.
He promised that the government would solve the problems of overlapping mining areas as soon as possible.
According to the ministry’s data, as of September, only 45 percent or 3,778 of 8,263 registered mining licenses (IUP) have the status of “clean and clear”, the remaining 4,485 licenses were problematic.
Bukit Asam and PT Mustika Indah, whose 75 percent share is owned by Adaro’s subsidiary PT Alam Tri Abadi, are currently in dispute over a mining area in South Sumatra. The case is now in the process of appeal process at the Supreme Court.
Bukit Asam sent a subpoena to Adaro on the disputed land. The company’s lawyer, Anton Dedi Hermanto, said earlier that Adaro claimed Mustika’s land did not overlap Bukit Asam’s mining areas.
He claimed that the mining right (KP) issued by the regent of Lahat for Mustika through the letter of authority number 540/65/KEP/PERTAMBEN/2005 with a total area of 2,742 hectares overlaps Bukit Asam’s exploration area.
The South Sumatra governor’s letter number 556/KPTS/PERTAMBEN/2004 which became Adaro’s reference did not eliminate the right of Bukit Asam over the exploration area of 26,760 hectares.
